1. About these terms

These terms govern your use of marathonvariety.com (the "Site"). The Site is operated by Marathon Variety, the operator-studio of Mark Laursen and Amber Sutera, with correspondence address Campus da Penteada, 9020-105 Funchal, Madeira, Portugal ("Marathon Variety", "we", "us").

By accessing or using the Site, you agree to these terms. If you do not agree, please stop using the Site.

2. What the Site is

The Site presents information about Marathon Variety, its practices, its work, and its publications. The Site is not a product marketplace, a financial service, or a regulated advisory platform.

3. Intellectual property

All content on the Site, including text, graphics, logos, photographs, articles, code, and the visual design, is owned by Marathon Variety or its licensors and is protected by Portuguese and international intellectual-property law.

You may view and quote excerpts of the Site for personal, non-commercial reference, journalistic, or academic purposes, provided you attribute the source clearly and link to the original. Any other use, including republishing, training of machine-learning models, or systematic copying, requires our prior written permission. Email hello@marathonvariety.com to request permission.

The "Marathon Variety" name and logomark are unregistered trademarks of the partnership. Use of either in commerce without written consent is prohibited.

4. Inquiries you submit

If you submit an inquiry through the contact form or by email, you confirm that the information you provide is accurate and that you have the right to share it. You grant Marathon Variety a limited, non-exclusive license to read your message, reply to it, and retain it for the purposes described in our Privacy Policy.

We do not treat unsolicited business proposals as confidential unless we have a written non-disclosure agreement in place. If your inquiry contains material you consider sensitive, mention that explicitly in the message.

5. No advice formed

Content on the Site, including articles in the Insights section, is general operator commentary. It is not legal, tax, financial, or investment advice, and it does not create a client relationship between you and Marathon Variety. Engagements begin only after a written agreement is signed.

6. Third-party content and links

The Site links to and embeds content from third parties, including published research, news articles, video trailers, and external project pages. We do not control those resources and are not responsible for their accuracy, availability, or terms.

7. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to interfere with, disable, or compromise the Site or its hosting infrastructure
  • Submit spam, malware, or fraudulent inquiries
  • Scrape the Site at a rate or volume that degrades service for others
  • Use Site content to train machine-learning models without our written permission

8. Disclaimer

The Site is provided "as is" and "as available". To the fullest extent permitted by Portuguese law, Marathon Variety disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of malicious code, or that information on the Site is accurate, current, or complete.

9. Limitation of liability

To the maximum extent permitted by Portuguese law, Marathon Variety and its founders are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site, even if we have been advised of the possibility of such damages.

Where a court of competent jurisdiction finds that Marathon Variety is liable, total aggregate liability is capped at one hundred euros (EUR 100) or the amount you have paid us in the twelve months preceding the claim, whichever is greater. Nothing in these terms excludes liability for fraud, willful misconduct, or any liability that cannot be excluded under Portuguese law.

10. Indemnity

You agree to indemnify and hold Marathon Variety harmless from any claim, damage, or expense (including reasonable legal fees) arising from your breach of these terms or your misuse of the Site.

11. Changes

We may update these terms from time to time. The current version lives at this URL with a "Last updated" date at the top. Continued use of the Site after a change means you accept the updated terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Portuguese Republic, without regard to conflict-of-law rules.

Any dispute arising out of or in connection with these terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Funchal, Madeira, with the courts of Lisbon as an alternative forum where required.
